Most of the legislation to be considered at the 2013 session has now been introduced, and although there are a few bills that have not yet been printed, I have now reviewed almost every bill that will be considered over the next few weeks. I am pleased to say that I am unaware of any legislation that will directly impact VAREI members in the areas of concern to which I am always trying to be vigilant: the statute and regulations affecting certified home inspectors, mold and mildew issues, and legislation which purports to expand your scope of responsibilities, such as the recent effort to add energy audits to the areas covered by a home inspection.
I frankly was expecting the issue of licensure versus certification to arise, and still believe it will whether it be because the realtors want to see that change, or a home buyer suffers losses due to an incomplete or incompetent home inspection (by a non-VAREI, non-certified home inspector). It appears that we will not have to fight that batttle this year, but in my opinion it is definitely an issue that is on the horizon.
You will note from the bills that I am tracking for VAREI (see attached matrix) that a number of bills are already moving through the process. HB 1641, a good bill whose provisions will apply to VAREI members, has already been reported out of committee and is headed to the full House of Delegates for consideration. I watched as a helpful amendment was added in committee giving regulants of DPOR an additional opportunity to have an informal fact-finding hearing. And SB 781, which creates new and substantial requirements for asbestos contractors and their workers, has already passed the Senate and is headed over the House for consideration.
There are still many weeks left to go, so I will continue to be vigilant. In the meantime, should any member of VAREI be aware of any legislation of concern or interest not covered in this report, please let me know.
